1. Acceptance of these terms

These Terms of Service ("Terms") govern your use of the Thromblo Creates website at thromblocreates.com and, in general, its projects, all provided by Thromblo Creates ("I"). By using this site or these projects, you agree to these Terms and to the Privacy Policy. If you do not agree, do not use them.

2. Who runs this and what it covers

Thromblo Creates is the name I release games, tools, mods and fiction under, including AwayWard, Quick BRT, ModernInc and Consensus. These Terms apply to all of them. A specific product may carry additional or more detailed terms, which control for that product. See, for example, the AwayWard Terms of Service.

3. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the site and projects. If you are a minor in your jurisdiction, review these Terms with a parent or guardian.

4. Acceptable use

You agree not to:

• Attack, overload, probe or attempt to gain unauthorized access to this site, its services or its servers, or circumvent rate limits and other protections.
• Submit unlawful, hateful, harassing, infringing or deliberately false content through the forms.
• Misuse these projects to harm others or for any unlawful purpose.
• Scrape, resell or redistribute this content except as expressly allowed.

Content may be removed and access suspended or blocked for violations.

5. Intellectual property

The Thromblo Creates name, logo, site design, original code, original art, music and game content are owned by Thromblo Creates or used under license. Several projects include third-party assets (art, icons, fonts, sound and shaders) under their own licenses; these are credited within each project's credits and documentation. Nothing here transfers ownership of my or third parties' intellectual property to you.

6. Downloads and third-party stores

• These apps and games are generally free to download. You are granted a personal, non-exclusive, non-transferable, revocable license to install and use them for your own non-commercial use, subject to any product-specific terms.
• You may share an unmodified official build with a friend, but you may not sell, rent or redistribute these projects for profit, or reverse engineer them except where that right cannot be excluded by law.
• Any purchase made through an external platform (for example Patreon, Steam, itch.io, Google Play or the Apple App Store) is governed by that platform's terms. Where purchases exist, they are cosmetic or convenience only, have no monetary value, and are licensed to you, not owned. Some products are ad-supported on mobile, with a one-time purchase to remove ads; details are in that product's own terms.

7. Your submissions

When you send a message or sign up for update notifications, you confirm the information is yours to share and grant me permission to use it to respond to you and operate the relevant feature. You are responsible for what you submit, and content that violates these Terms may be removed.

8. Use of AI models

This site and these projects are developed with the assistance of AI models used as development tools to accelerate coding and assist with creative production, specifically OpenAI models (the GPT-5.6 family), Anthropic models (the Claude family) and Z.ai models (such as the GLM family). These websites and shipped products do not send your personal data to these models during normal use, and your data is not used to train AI models. See the Privacy Policy for details.

9. Disclaimers

The site and these projects are provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability and non-infringement, to the fullest extent permitted by law. There is no warranty that they will be uninterrupted, error-free or secure, or that data will never be lost.

10. Limitation of liability

To the fullest extent permitted by law, Thromblo Creates will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, progress or profits, arising out of or related to your use of the site or its projects. Where liability cannot be excluded, it is limited to the amount you paid me, if any, in the 12 months before the claim. Nothing in these Terms limits rights that cannot be limited under applicable law.

11. Indemnification

You agree to indemnify and hold harmless Thromblo Creates from claims arising out of your breach of these Terms, your content, or your misuse of the site or projects, to the extent permitted by law.

12. Changes to these terms

These Terms are subject to change. As these projects evolve, and as products add or change online features such as AwayWard's cloud saving and cross-play, these Terms may be updated to reflect the current state of the site and projects. The "Last updated" date above will be revised and, for material changes, notice will be given through the site or the community channels. Continued use after a change means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of the United States of America, without regard to its conflict-of-law rules. You agree to submit to the jurisdiction of the competent courts of the United States for any disputes, subject to any mandatory consumer protections in your own country of residence.
